This Privacy Policy (“Privacy Policy”) describes what information we collect from you, how we use that information, how we protect and secure it, and what choices you have regarding how your information is used. For purposes of this Privacy Policy, the terms “we,” “us,” “our,” and “Tools of the Mind” refer to Tools of the Mind, Inc., a Massachusetts nonprofit corporation, and its fiscally sponsored partner Tools of the Mind. “You” and “your” refers to you, as a user of the Site. “Site” refers to www.toolsofthemind.org and all webpages contained within the toolsofthemind.org domain. By accessing or using the Site in any way, you confirm your agreement to this Privacy Policy and consent to our collection and use of your information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use the Site or provide us with your personal information.

Information We Collect

While you are visiting the Site, we may collect and store information about you: information you voluntarily provide to us, and information collected through automatic data collection technologies.

Personal Information

Personal information is information that identifies you personally, such as your name, address, email address, telephone number, date of birth, and includes personal information you voluntarily provide to us. You may choose to provide personal information through the Site or to us via other methods, such as in email communications or offline activities and communications (including product registration and social media communications).

In certain situations, you may be required to enter personal information. For example, in order to register for the eTools section of the Site, you must provide your name, email address and organization. To sign up to attend a live training, you must provide your name, address, email address, and organization. In these situations, you can choose to withhold personal information from us, though the failure to provide personal information may prevent you from registering, using certain parts of the Site or taking advantage of all of the Site’s features or other products and services we may offer from time to time. In addition, we may retain records of any messages that you may send to us through the Site, by email, by communication with us through social media sites, or by posting on the Site.

We may use the personal information collected about you for the following purposes:

  • Create, administer and communicate with you about your account;
  • Provide, administer and communicate with you about our products and services;
  • Process and respond to your requests and inquiries;
  • Verify your identity to ensure security for the other purposes listed here; and
  • Send you informational and promotional content that you may choose (or “opt in”) to receive (You can stop receiving our promotional emails by following the unsubscribe instructions included in every email).

Information Collected Automatically

While you can access and browse the Site without disclosing any personal information, you nonetheless automatically disclose certain information about your interaction with the Site, such as the webpages most frequently accessed by you, time spent on a webpage or area of the Site, the number of visits to the Site by you, type of browser/device/hardware used by you, Internet protocol address, or search terms entered by you. Such information is used in a collective manner, and no one person can be identified by that compiled information. It helps us to manage and improve the Site and deliver a better and more personalized user experience.

We use cookies on the Site to enhance your experience while using the Site by, for example, keeping you logged into your account and providing easier Site navigation and access to forms. A cookie is a small amount of data that is sent to your web browser from a Web server and stored on your computer’s hard drive. You may refuse to accept browser cookies by activating the appropriate setting on your browser. If you select this setting, however, you may be unable to access certain parts of the Site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Site. The Site does not currently recognize browser “Do Not Track” signals.

Sharing of Information

We may share and disclose anonymized, aggregated information about our users, and information that does not identify any individual, without restriction. We do not share personal information with any third parties other than as we determine is necessary for third parties to perform services for us or on our behalf. However, such third parties are obligated to maintain the confidentiality of personal information and are not authorized to use personal information for any purpose other than providing those services.

We may release personal information we have collected when legally required to do so, at the request of governmental or law enforcement authorities conducting an investigation, to verify or enforce compliance with the policies governing the Site and applicable laws, or to protect against misuse or unauthorized use of the Site. We also reserve the right to share, assign, or transfer your personal information to any of our affiliates or in the event we sell or transfer all or a portion of our business or assets.

We may include user testimonials on the Site or in other promotional materials, which may contain personal information. We obtain the user’s consent to post the user’s name along with his or her testimonial via email prior to including the testimonial on the Site or in other promotional materials. We may transfer information about you if Tools of the Mind is acquired by or merged with another company or sells some or all of its assets. In this event, we will notify you by email (if you have an active eTools account) or by putting a prominent notice on the Site before information about you is transferred and becomes subject to a different privacy policy.

Retention of Information

We will retain personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer period is required or permitted by applicable law or any applicable internal document retention policies.

Information from Children

We do not collect or maintain information from those actually known to be under the age of 13, and no part of the Site is structured to attract anyone under the age of 13. If we become aware that we have inadvertently collected or received personal information from a visitor under the age of 13, we will delete the information from our records.

Security Measures

We follow generally accepted industry standards to protect your personal information from unauthorized access, both during transmission and once we receive it. However, no data transmission over the Internet or other network can be guaranteed to be 100% secure. As a result, while we strive to protect information transmitted on or through the Site, we cannot and do not guarantee the security of any information you transmit on or through the Site, and you do so at your own risk. If you have an eTools account, your eTools account information is protected by a password. It is important that you protect against unauthorized access of your account and information by choosing your password carefully, and keeping your password and computer and other electronic devices (such as smart phones) secure by signing out after using our services.

Links to Other Sites

This Privacy Policy applies only to the Site and not to any third party websites. We may provide links to other websites that we believe may be of interest to the Site users, including links to third party websites through which users may purchase Tools of the Mind products and/or services. If you decide to visit any linked website, you do so at your own risk. Any such third party websites may be subject to their own terms of use and policies and procedures (including privacy policies). We do not guarantee the standards of every website to which we provide a link, and we are not responsible for and have no control over the terms of use or the policies and procedures (including privacy policies) of such third party websites or for the content, information, goods or services available through such websites. We are not responsible for the content of linked websites or the use of those websites, and we encourage you to read the terms and conditions of use (including the privacy policies) of those other websites before using such websites to learn how they collect and use information about you.

Changes to this Privacy Policy

We reserve the right to change this Privacy Policy, along with related procedures, at any time and without prior notice to you. If we do make any changes, we will post them on the Site and we will indicate at the top of this Privacy Policy when it was most recently updated. Your continued use of this Site after changes to this Privacy Policy have been posted will be considered your acceptance of those changes, so please check this Privacy Policy periodically for updates.
